What is an Affidavit of Marriage?
A joint affidavit of marriage is what a married couple gives an authority that needs the marriage confirmed but will not work from the marriage certificate alone — or where no certificate exists because the marriage was solemnised by custom and never registered.
It is a supporting document, not proof of marriage in the way a registered certificate is. Where you can register the marriage and produce a certificate, do that: it is stronger, permanent, and accepted everywhere. Use this affidavit alongside it, or where an authority specifically asks for a joint declaration.
When to use it
- Adding a spouse’s name to a passport, and the Passport Office asks for a joint affidavit in its annexure format.
- Adding a spouse as a nominee or joint holder in a bank account, insurance policy or provident fund.
- Updating a surname after marriage in employer, bank or institutional records.
- The marriage was solemnised by religious or customary rites and has not been registered.
- An authority asks for written confirmation of the marriage from both spouses.

How it works
Get the marriage details right
The exact date and place of the marriage, and the rites under which it was solemnised. These must agree with the marriage certificate or the wedding invitation and photographs, if you have them.
Use both spouses’ full legal names
As they appear on each spouse’s Aadhaar or passport, together with each father’s name. A mismatch here is what stalls passport applications.

Both spouses sign before the notary
Print on non-judicial stamp paper of your state’s value. Both of you attend the Notary Public together with your original IDs and sign in the notary’s presence.
How to make it legally valid
- Non-judicial stamp paper of the value prescribed by your state.
- Signed by BOTH spouses in the physical presence of a Notary Public. A joint affidavit signed by one spouse is not a joint affidavit.
- Notary’s signature, seal and register entry.
- Where the authority publishes its own format — the Passport Office annexures, for instance — use theirs.
- This affidavit supports a marriage; it does not create one, and it does not substitute for registration where registration is required.
Stamp paper. Print the affidavit on non-judicial stamp paper. The value is fixed by your state, not by us — commonly Rs. 10 in Delhi and Uttar Pradesh, Rs. 20 in Karnataka and Tamil Nadu, Rs. 50 in Telangana and Andhra Pradesh, and Rs. 100 in Maharashtra and Gujarat. Ask the stamp vendor or your notary for the current value in your state: using a lower denomination than required is the most common reason an affidavit is handed back.
Common mistakes to avoid
- Treating the affidavit as a substitute for registering the marriage. Register it where you can — the certificate is far stronger.
- Only one spouse signing.
- Names that do not match the IDs being submitted with it.
- A marriage date that conflicts with the marriage certificate or with other filings.
- Ignoring the Passport Office’s own annexure format when applying for spouse name inclusion.
Frequently asked questions
Does this affidavit prove my marriage?
It is evidence of what both spouses declare on oath, and authorities accept it as supporting proof. It is not as strong as a marriage certificate issued by the Registrar, which is the primary proof. Where both are available, submit both.
Can I use this instead of registering my marriage?
No, and you should not try to. Registration under the Hindu Marriage Act, the Special Marriage Act or your state’s rules gives you a permanent official record that every authority accepts. The affidavit supports it; it does not replace it.
Do both husband and wife have to sign?
Yes. It is a joint affidavit and both spouses must swear it before the notary. If one spouse cannot attend, each can swear a separate individual affidavit instead.
Will the Passport Office accept this for spouse name inclusion?
The Passport Office has its own prescribed annexures for marriage-related applications. Use their format where one is prescribed; this affidavit covers the standard content for authorities that do not prescribe a format.
Our marriage was not registered. Is it still valid?
A marriage solemnised according to valid rites is legally valid even if unregistered — but proving it later, especially for inheritance, insurance or immigration, is much harder. Register it if you can; most states allow registration long after the wedding.
Can we use this to change the wife’s surname?
It supports the change by confirming the marriage, and many banks and employers will act on it. For a formal name change across records, use a name change affidavit and the newspaper and Gazette route.
What if one spouse was previously married?
Disclose it and attach the decree of divorce or the death certificate of the earlier spouse. The affidavit as drafted declares that neither party had a living spouse at the time of this marriage — that declaration must be true.
Do we need witnesses?
Not for the affidavit — the notary attests it. Witnesses matter for the marriage itself and for registration, where two or three are usually required.
What stamp paper value applies?
The ordinary affidavit value in your state, commonly Rs. 10 to Rs. 100. One stamp paper covers the joint affidavit.
Can this be used for a visa or immigration application?
Foreign missions almost always want the registered marriage certificate, often apostilled, and will not accept an affidavit in its place. Register the marriage before applying.
