What is a Legal Notice for Recovery of Money?

A legal notice for recovery of money is a formal written demand to someone who owes you money — under a loan, an agreement or an unpaid invoice — setting out the facts, the amount due and a deadline to pay, and stating that legal proceedings will follow if they don’t.

For most private money claims a notice is not legally compulsory before suing, but it is almost always sent first: it often produces payment or a settlement, and it creates a dated record that the debtor was asked to pay. Separate rules apply to bounced cheques, where a notice within a fixed time is mandatory — use the cheque bounce notice for that.

When to use it

  • A friend, relative or business has not repaid a loan by the agreed date.
  • A client has not paid invoices for goods supplied or services rendered.
  • Money is due under an agreement and reminders have gone unanswered.
  • You want to put the demand on record before filing a civil suit for recovery.

What you'll need

Keep these details ready — the form asks for them in this order.

Basics

Notice date · Who is sending this notice? (optional)

Creditor

Your name · Your address

Debtor

Debtor name · Debtor address

Debt

Details of the transaction/debt · Date the money was given (optional) · How was it paid? (optional) · Amount originally given (optional) · Amount already returned (optional) · Balance amount due now · Interest claimed (optional) · Documents that support your claim (optional) · Days given to pay · Account to pay into (optional)

How it works

  1. Enter sender and recipient

Your details and the debtor’s full name and last known address.

  2. Set out the facts

How the amount became due — the date, how it was paid, agreement or invoices — the amount given, any part-payment already returned, the balance due and any interest claimed.

  3. Set the demand and deadline

The total demanded and the period to pay (commonly 15 to 30 days).

  4. Preview, pay and download

Review the notice, pay ₹100 and download it.

  5. Sign and send with proof of delivery

Sign it and send by registered post AD or speed post, keeping the receipts and tracking record.

How to make it legally valid

  • Accurate facts and amounts, consistent with the loan papers, agreement or invoices you can produce.
  • Sent to the debtor’s correct address, by a method that gives proof of dispatch and delivery.
  • Copies of the notice and the postal receipts kept safely — they are evidence in any later suit.
  • Act within the limitation period: a suit to recover money generally has to be filed within three years of when it became due.

Common mistakes to avoid

  • Claiming an amount that doesn’t match your records, which undermines the notice.
  • Sending it by a method with no proof of delivery.
  • Using this general notice for a bounced cheque, which has its own strict timeline.
  • Letting the limitation period run out while waiting for a reply.
