Stamp paper required — non-judicial stamp paper of the value prescribed by your state. You'll receive the draft; e-stamping is done separately per your state's rules.

What is a Domicile Affidavit?

Domicile is the state you belong to for legal purposes — where you have your permanent home and intend to keep it. States use it to allocate reserved seats in colleges, state government jobs, and a range of welfare benefits, which is why a domicile certificate is one of the most-requested documents in India.

This affidavit is your sworn declaration supporting the application. The certificate itself is issued by the Revenue authority — Tahsildar, SDM or district office, depending on the state — after it verifies your claim.

When to use it

  • Applying to the Tahsildar or SDM for a state Domicile or Residence Certificate.
  • Claiming a state quota seat in a medical, engineering or other professional course.
  • Applying for a state government job that is open to domiciles of the state.
  • Applying for a state scholarship or welfare scheme limited to residents.
  • The authority asks for a sworn declaration of residence alongside your documentary proof.

How it works

  1. Check your state’s residence requirement

States differ — some ask for continuous residence of three years, others five, ten or fifteen, and some confer domicile by birth or by a parent’s domicile. Confirm what your state requires before you declare a period.

  2. Fix the year you started residing there

Use a year you can evidence: school records, ration card, voter roll entry, land records or continuous address proof. The Revenue office will verify it.

  4. Print on stamp paper and notarise

Print on non-judicial stamp paper of your state’s value and swear it before a Notary Public.

  5. File it with the application

Submit to the Tahsildar, SDM or the state e-district portal along with identity proof, address proof, and evidence of the residence period.

How to make it legally valid

  • Non-judicial stamp paper of the value prescribed by your state.
  • Sworn in the physical presence of a Notary Public or First Class Magistrate.
  • Notary’s signature, seal and register entry.
  • The residence period declared must be supportable by documents — the Revenue office verifies, and often makes a local enquiry.
  • You can only claim domicile of one state. A parallel claim in another state will surface and defeat both.

Stamp paper. Print the affidavit on non-judicial stamp paper. The value is fixed by your state, not by us — commonly Rs. 10 in Delhi and Uttar Pradesh, Rs. 20 in Karnataka and Tamil Nadu, Rs. 50 in Telangana and Andhra Pradesh, and Rs. 100 in Maharashtra and Gujarat. Ask the stamp vendor or your notary for the current value in your state: using a lower denomination than required is the most common reason an affidavit is handed back.

Common mistakes to avoid

  • Claiming a residence period longer than your documents support. Verification is real and the certificate is refused.
  • Confusing a domicile certificate with a residence certificate. Some states issue both, for different purposes — ask which one the scheme wants.
  • Applying for domicile in two states, for instance where you study in one and your family lives in another. Only one can be claimed.
  • Assuming your parents’ domicile automatically passes to you. In most states it does, but the rule varies and needs to be stated correctly.
  • Using this where the state publishes its own affidavit format with the application form.

Frequently asked questions

What is the difference between domicile and residence?

Residence is where you currently live. Domicile is where you have your permanent home and intend to remain indefinitely. You can reside temporarily in one state while remaining domiciled in another — which is exactly the distinction state quota rules are built on.

How many years of residence do I need?

It varies by state — commonly three, five, ten or fifteen years of continuous residence, with separate rules for people domiciled by birth or through a parent. Check your state’s Revenue department rules before declaring a period.

Can I have domicile in two states?

No. You have one domicile at a time. Applying in two states risks both certificates being cancelled and can amount to a false declaration on oath.

What documents support a domicile application?

Typically identity proof, address proof, a ration card where your state uses one, school leaving or transfer certificate, voter roll entry, land or property records, and your parents’ domicile certificate where domicile is claimed through them. The exact list is set by each state.

Does a married woman take her husband’s domicile?

Most states allow a woman married to a domicile of the state to apply on that basis, usually with the marriage certificate and the husband’s domicile certificate. The rule and the waiting period differ by state, so check locally.

How long does the certificate take to issue?

Usually two to four weeks after application, as the Revenue office verifies the claim and often conducts a local enquiry. Several states now issue it through an e-district portal, which can be faster.

How long is a domicile certificate valid?

In most states it is issued once and does not expire, though some institutions ask for one issued within the last one to three years. Check what the authority in front of you requires.

Can a student studying in another state claim domicile there?

Studying in a state does not by itself create domicile there. Domicile requires a permanent home and the intention to remain. Most state quota rules explicitly exclude residence purely for education.

Does this affidavit need to be notarised?

Yes. Revenue offices will not act on an unnotarised declaration.

What stamp paper value applies?

The ordinary affidavit value in your state, commonly Rs. 10 to Rs. 100. Confirm with the stamp vendor or notary.
