What is a Legal Heir Certificate Application Affidavit?
A Legal Heir Certificate is issued by the Revenue authority — usually the Tahsildar — and identifies who the surviving heirs of a deceased person are. Families need it constantly: to claim a pension, provident fund or gratuity, to transfer a utility connection, to mutate a property, to settle a modest bank balance.
This affidavit is what you file with the application. The Tahsildar does not take your word for the list of heirs — a Revenue Inspector or Village Officer will normally make a local enquiry — but the affidavit is the sworn statement the whole file is built on.
When to use it
- Applying to the Tahsildar or Revenue office for a Legal Heir Certificate.
- Claiming a deceased government employee’s pension, family pension, provident fund or gratuity.
- Applying for mutation of agricultural or house property into the heirs’ names.
- Transferring an electricity, water or gas connection after the holder’s death.
- Claiming employment on compassionate grounds after a government employee’s death.

How it works
Get the death certificate
From the municipal corporation, municipality or panchayat that registered the death. The application cannot proceed without it, and its number should be quoted in the affidavit.
List every surviving heir
One per line, with name, relationship and age. Include minors, heirs living abroad, and heirs who do not intend to claim. An omitted heir can have the certificate cancelled, and the omission is a false statement on oath.
Identify the right Tahsildar
Jurisdiction usually follows the place the deceased last resided, not where you live. Confirm before filing.

Print on stamp paper, notarise and file
Print on non-judicial stamp paper of your state’s value, swear it before a Notary Public, and file it with the application, the death certificate, and proof of relationship for each heir.
How to make it legally valid
- Non-judicial stamp paper of the value prescribed by your state.
- Sworn in the physical presence of a Notary Public or First Class Magistrate.
- Notary’s signature, seal and register entry.
- The list of heirs must be complete — the affidavit declares on oath that none has been omitted.
- Filed before the Tahsildar with jurisdiction over the deceased’s last residence.
- Where your state publishes its own affidavit annexure with the application, use theirs.
Stamp paper. Print the affidavit on non-judicial stamp paper. The value is fixed by your state, not by us — commonly Rs. 10 in Delhi and Uttar Pradesh, Rs. 20 in Karnataka and Tamil Nadu, Rs. 50 in Telangana and Andhra Pradesh, and Rs. 100 in Maharashtra and Gujarat. Ask the stamp vendor or your notary for the current value in your state: using a lower denomination than required is the most common reason an affidavit is handed back.
Common mistakes to avoid
- Omitting an heir — a married daughter, a child from an earlier marriage, an heir abroad. This is the commonest and most serious error.
- Filing before the wrong Tahsildar. Jurisdiction follows the deceased’s last residence.
- Declaring an intestate death when a will exists.
- Expecting the Legal Heir Certificate to work for everything. Banks and companies require a court-issued Succession Certificate for larger sums and for shares and securities.
- Applying without the death certificate in hand.
Frequently asked questions
What is a Legal Heir Certificate used for?
It identifies the surviving heirs of a deceased person, and is used for pension and family pension claims, provident fund and gratuity, transfer of utility connections, property mutation, and compassionate appointment. It is not a determination of title to property.
How is it different from a Succession Certificate?
A Legal Heir Certificate is issued by the Revenue authority and identifies the heirs. A Succession Certificate is granted by a civil court and authorises the holder to collect the deceased’s debts and securities. Banks and companies require the court certificate for larger amounts and for shares.
Who can apply?
Any legal heir of the deceased — spouse, child, parent, or sibling where they are an heir under the applicable succession law.
Where do I apply?
To the Tahsildar, Taluk office or Revenue office having jurisdiction over the place the deceased last resided. Many states now accept applications through an e-district portal or a common service centre.
What documents are needed?
The death certificate, this affidavit, proof of the applicant’s identity and address, proof of relationship for each heir (Aadhaar, ration card, birth certificates, school records), and the deceased’s address proof. Some states also require an application in a prescribed form with a court fee stamp.
How long does it take?
Typically two to six weeks. A Revenue Inspector or Village Officer normally conducts a local enquiry to verify the list of heirs before the certificate is issued.
Does every heir have to sign?
One heir applies and swears the affidavit, but the Revenue office usually verifies with the others during the enquiry, and some states ask for a no-objection from the remaining heirs.
What if an heir is a minor?
List the minor with their age. A natural guardian acts for them; for anything substantial, a guardianship order from a court may be required.
What if the deceased left a will?
Then the will governs and the route is probate or letters of administration, not this affidavit. Declaring an intestate death when a will exists is a false statement on oath.
What stamp paper value applies?
The ordinary affidavit value in your state, commonly Rs. 10 to Rs. 100. Some states also require a court fee stamp on the application form itself.
