What is a Medical / Healthcare Power of Attorney?

A medical or healthcare power of attorney names someone you trust to make decisions about your medical treatment if you are unable to decide for yourself — during an illness, after an accident, or in old age.

Indian law has no single statute for healthcare powers of attorney, so hospitals may treat this document as strong evidence of your wishes rather than a binding authority. For end-of-life treatment choices, the Supreme Court has recognised advance medical directives (“living wills”) with their own execution requirements; for mental healthcare, the Mental Healthcare Act, 2017 lets you appoint a nominated representative. Consider these alongside this document.

When to use it

  • You want a named person to speak for you with doctors if you are incapacitated.
  • An elderly parent wants a child to handle hospital decisions.
  • You are about to undergo major surgery or treatment.

How it works

  1. Enter yourself and your agent

Your details and those of the person you are appointing.

  2. Describe the powers

The kinds of medical and healthcare decisions the agent may make, and any wishes or limits.

  3. Preview, pay and download

    Pay ₹125 and download.

  4. Sign, witness and notarise

Sign before witnesses and a notary, and give copies to your agent and doctor.

How to make it legally valid

  • Signed by you while you have capacity, with two witnesses.
  • Notarised, which makes it more readily accepted by hospitals.
  • For end-of-life wishes, a separate advance directive executed as the Supreme Court’s guidelines require.

Common mistakes to avoid

  • Assuming every hospital must follow it — discuss it with your doctors in advance.
  • Not telling the agent and family that it exists.
  • Mixing financial and medical powers in one document.
