What is a Patent Assignment Agreement?
A patent assignment agreement transfers ownership of a patent, or a pending patent application, from the inventor or current owner to another person or company.
Under the Patents Act, 1970, an assignment is valid only if it is in writing and duly executed, and the new owner should apply to the Controller of Patents to have its title registered. Until it is registered, the assignee may struggle to enforce the patent.
When to use it
- An inventor is transferring an invention to their company.
- A patent is being sold or transferred as part of a business deal.
- A pending application needs to be moved to a new applicant.
