What is a Property Management / Caretaker Agreement?

A property management or caretaker agreement engages a person or agency to look after a property for an owner who lives elsewhere — often an NRI or an owner in another city. It sets out the duties (upkeep, paying bills and taxes, finding and dealing with tenants), the fee, and the limits of the manager’s authority.

Its most important job is to make clear that the caretaker is only managing the property on the owner’s behalf and gets no tenancy or ownership right in it.

When to use it

  • You own a property in a city where you don’t live and need someone to maintain it.
  • An NRI owner wants a relative or agency to deal with tenants, repairs and bills.
  • A vacant property needs periodic inspection and security.

How to make it legally valid

  • Signed by the owner and the caretaker or agency, with witnesses.
  • Stamp duty where your state charges it on agreements.
  • A clause that the caretaker occupies (if at all) only as the owner’s agent, not as a tenant.
  • If the caretaker is to sign leases or deal with authorities, a separate power of attorney.

Common mistakes to avoid

  • Letting the caretaker live in the property with no written terms — the most common route to a tenancy claim.
  • Giving power to sell or mortgage through a management agreement.
  • No reporting or accounts obligation for rent and expenses handled.
